1. Introduction
These Terms of Service ("Terms," "Agreement") govern the pet-waste removal services ("Services") provided by K9 PooPickers LLC, a Missouri limited liability company ("Company," "we," "us," or "our"), to the client ("Client," "you," "your"). By signing up for Services or allowing us access to your property, you agree to these Terms.
2. Definitions
Services: Pet-waste removal, yard scooping, waste hauling and disposal, and any add-on services mutually agreed.
Service Location: The Client's yard, property, or designated area where Services occur.
Pets: Any animals present at or near the Service Location.
Technician: Any employee, agent, or contractor performing Services for the Company.
3. Scope of Services
We provide recurring, scheduled, or one-time pet-waste removal Services as selected by Client. Technicians will remove visible and accessible pet waste from the designated area at each scheduled visit. Waste will be bagged and disposed of either in the Client's designated trash bin or by transport and disposal through Company-approved methods. We do not guarantee removal of hidden waste (e.g., under excessive debris, tall grass, snow, or obstacles). We do not guarantee a specific time of day for service; only the scheduled day.
4. Compliance with Missouri & Local Law
4.1 Solid Waste Disposal Compliance
K9 PooPickers LLC agrees to handle and dispose of pet waste in compliance with: Missouri Solid Waste Management Law (RSMo Chapter 260); Missouri Department of Natural Resources regulations governing the collection and disposal of solid waste; Any applicable St. Louis County or municipal sanitation ordinances; Any waste-hauler, landfill, or collection regulations where disposal occurs. We reserve the right to refuse or modify any disposal request that violates state or local regulations.
4.2 Local Animal Waste Ordinances
Client acknowledges that municipalities within St. Louis County may impose additional requirements on pet owners regarding timely cleanup and disposal of animal feces. We may notify you if your local ordinance imposes rules that affect our Services.
5. Client Responsibilities
Client agrees to:
- 1. Provide safe, unobstructed access to the Service Location (e.g., unlocked gates).
- 2. Secure or restrain all pets during service (indoors or in a secure area).
- 3. Maintain reasonable yard conditions so technicians can safely perform Services.
- 4. Notify us in advance of: additional pets, extended absence, inaccessible yard, gate/lock changes, or major yard obstructions.
We may skip service if conditions are unsafe, if pets prevent access, or if yard access is blocked. Skipped visits due to Client responsibility may be charged.
6. Payment Terms
Services are billed in advance or on an agreed schedule. First-time or one-time cleanups may incur an additional fee based on yard condition and volume of waste. Late or failed payments may result in suspension of Services. Returned payments may incur a handling fee.
7. Cancellation, Pausing, & Service Modifications
Either party may cancel at any time with reasonable notice. We may pause or reschedule Services for: weather, unsafe conditions, pet interference, yard inaccessibility, or nonpayment. If access is blocked upon arrival, we may charge the full visit amount.
8. Safety & Property Conditions
Technicians may decline service when hazards are present (aggressive pets, excessive debris, standing water, snow/ice covering waste, unsafe yard conditions). Client is responsible for maintaining a reasonably safe environment.
9. Liability, Damages & Legal Limitations (Missouri-Compliant)
Missouri law does not allow businesses to waive liability for gross negligence or willful misconduct. Therefore, the following applies:
9.1 Limited Liability for Ordinary Negligence
To the fullest extent allowed under Missouri law, Client agrees that K9 PooPickers LLC is not liable for minor or ordinary negligence arising from: accidental damage to lawns or non-structural yard features, incidental tracking of waste beyond our control, missed waste hidden or inaccessible at time of service, minor contact with landscaping or personal property inherent to the nature of the service.
9.2 No Waiver for Gross Negligence or Willful Misconduct
Nothing in this Agreement releases us from liability for conduct that Missouri law prohibits from being waived.
9.3 Pet-Related Risks
Client remains fully responsible for their pets. We are not responsible for: pets escaping due to defective gates/fencing, injuries caused by Client's pets, pet behavior or health issues unrelated to our direct actions.
9.4 Indirect / Consequential Damages
We are not liable for indirect, incidental, special, or consequential damages unless required by Missouri law.
10. No Guaranteed Results
We remove visible waste, but we do not guarantee: detection of all waste, yard sanitation beyond scooping, removal of waste inaccessible due to weather, obstacles, or yard conditions.
11. Privacy & Property Access Consent
Client grants permission for technicians to enter the Service Location solely for performing Services. We do not enter homes or any secured structures.
12. Changes to Terms
We may update these Terms with written notice to Clients. Continued service constitutes acceptance.
13. Governing Law
This Agreement is governed by the laws of the State of Missouri and applicable St. Louis County ordinances.
14. Severability Clause (Missouri-Necessary)
If any provision of this Agreement is determined to be invalid under Missouri law, that provision will be removed or limited only to the minimum extent necessary, and the remainder of the Agreement will remain in full force.
15. Entire Agreement
These Terms constitute the entire agreement between Client and K9 PooPickers LLC and supersede any prior verbal or written agreements.
